This referral program is only valid in locations where Geni Homes currently operates. Geni Homes reserves the right to update, modify, or terminate the referral offer at any time without advance public notice. In case of any dispute or ambiguity, Geni Homes retains the right to make the final decision regarding interpretation. Cashback or referral rewards cannot be combined with any other promotional offers.
By using our services, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these conditions, please refrain from accessing the platform or using the services.
1. Our Services
a) Geni Homes serves as a platform that connects customers with a variety of service providers (“SPs”) and helps them find the best match based on their preferences.
b) Once a formal agreement is signed between the customer and the SP, and a copy is shared with Geni Homes, our team monitors the execution and updates clients on project development throughout its various phases.
c) Construction material supply is offered only to registered business entities (B2B customers).
d) Retail (B2C) customers or individuals are not eligible to purchase building materials through the Geni Homes supply division.
e) Material supply timelines are defined by category and handled by our supply chain team within predetermined schedules.
f) Invoices for materials will be generated and sent to the registered business within 48 hours of delivery.
g) Quoted construction packages are subject to changes based on total built-up area and number of floors involved in the project.
2. Accessing and Using Our Website & Services:
Initiating Service Access
When creating an account, users must ensure all information provided is accurate and current. All critical notifications will be sent to the email address registered, and it is your responsibility to keep it up to date for official communications.
Usage Restrictions
You agree not to Alter, replicate, or distribute our services or any component thereof;
• Reverse-engineer, decode, disassemble, or otherwise attempt to access source code or system architecture;
• Lease, sublicense, or lend access to the services to any other party;
• Remove proprietary trademarks or labels on our platform;
• Build derivative works from our service or software;
• Use our services for any illegal activity or breach of our stated Terms.
Your responsibilities include:
• Ensuring your team or representatives comply with these Terms;
• Taking reasonable precautions to prevent unauthorized access;
• Using our platform only in accordance with applicable laws and our guidelines;
• If you are purchasing building materials, you confirm that you are a registered business entity compliant with the applicable laws.
Service Charges
Usage of service providers’ offerings will incur service fees ("SP Charges"), and usage of Geni Homes’ platform and support services will incur platform fees ("Geni Homes Charges"). Together, these are referred to as “Charges.”
Charges, including any cancellation fees and applicable taxes, will be disclosed upfront before you confirm any transaction.
It is your responsibility to review and accept these Charges before proceeding with any service or purchase.
Payment Terms
• Payments are due immediately at the start or provision of any product or service.
• All payments are final and non-refundable unless explicitly stated otherwise at the sole discretion of Geni Homes.
• Geni Homes facilitates payments between customers and SPs but does not act as a direct party to the service/product transactions between both.
• All purchases and agreements between you and any SP are considered separate from Geni Homes' obligations.
3. Service Provision
Technical Assistance – Geni Homes offers standard technical support as part of its services. Registered users, including Service Providers (SPs) and End Customers, are given access to our digital platform to enable seamless communication and transaction processing between both parties. This includes coordination for service execution and payments, as per the mutually agreed terms. Geni Homes does not act as a representative or agent for either party and shall not be held accountable for any direct or indirect transaction outcomes between platform users.
By providing digital service access, Geni Homes strictly prohibits the uploading of any material that is illegal, defamatory, offensive, obscene, or otherwise inappropriate. Any user found violating this will face immediate account termination without notice, and other actions as deemed necessary.
4. Service Cancellation Policy
Please refer to our detailed Service Cancellation Policy document for applicable terms, conditions, and processes regarding service termination.
5. Account and Transaction Information
a) Geni Homes may record details of commercial interactions, such as goods/services provided, costs, payment status, and descriptions of deliverables, on its platform (“Transaction Information”). Such data may be exchanged between SPs and customers via various communication modes, including calls, text messages, WhatsApp, email, or other electronic means, based on the contact details available.
b) At the time of entering the first transaction involving a customer, Geni Homes will inform the customer of its intention to record and manage related data through the platform and will request explicit consent from the customer for the following:
i. To create a digital profile using the customer’s contact number and associated details;
ii. To share transaction-related information for improving Geni Homes’ services;
iii. To receive communications regarding: - Transaction details and updates - Payment notifications - Platform and service information - Promotions or offers - Any service-related communications
c) If a customer does not provide consent or later revokes it, the Service Provider must immediately discontinue the use of Geni Homes’ services for that specific customer.
6. User Responsibilities
a) Users affirm that the information submitted through the platform is accurate, complete, and truthful as of the date of accepting these terms. They also agree to maintain accuracy for the duration of service use. In case of any changes, users must update Geni Homes immediately. The company is not liable for any losses caused by incorrect, outdated, or incomplete data provided by the user.
b) Users are solely responsible for ensuring compliance with all applicable legal obligations. Any legal breach and resulting penalties or consequences will be the sole liability of the user.
c) Users must cooperate fully with Geni Homes in the event of any legal or regulatory proceedings that may be initiated due to a violation of these terms.
d) While Geni Homes implements regular system backups, users are strongly encouraged to independently backup and archive their transaction data to prevent data loss.
e) Users may only utilize the services as explicitly permitted under these terms. Users shall not:
i. Violate any intellectual property rights such as copyrights, trademarks, patents, or trade secrets;
ii. Reproduce, modify, distribute, or create derivative works from the services except where allowed;
iii. Upload or transmit malicious software such as viruses, spyware, worms, keyloggers, or harmful code intended to disrupt systems;
iv. Use bots, crawlers, or similar tools to extract or replicate platform content;
v. Compile or aggregate data from the platform for external database or directory creation;
vi. Use the services in any manner that is illegal, fraudulent, harmful, or in conflict with these Terms;
vii. Breach any laws or regulations while using the services.
7. Intellectual Property Rights
a) All proprietary rights, ownership, and intellectual property associated with the Platform and Services are either owned by or lawfully licensed to Geni Homes. Subject to the User’s adherence to these Terms, Geni Homes grants a limited, revocable, non-transferable, nonsublicensable, royalty-free, and non-exclusive license to access and use the Platform and its Services as outlined in these Terms and as per official instructions provided from time to time.
b) Geni Homes may, from time to time, invite Users to share suggestions, enhancements, bug reports, or other inputs relating to the Platform or its Services (“Feedback”). By providing such Feedback, Users grant Geni Homes unrestricted rights to use, reproduce, adapt, disclose, distribute, and otherwise exploit such input without any obligation of royalty, attribution, consent, or limitation stemming from the User’s intellectual property claims.
c) Unless explicitly stated in this agreement, these Terms do not grant any ownership or usage rights to Users over the intellectual property belonging to Geni Homes or any third party.
8. Duration and Termination
a) These Terms will remain effective until either party terminates them as outlined in this section.
b) Geni Homes reserves the right to revoke a user’s access to any part of the Services with immediate effect, at its sole discretion, in the event of any breach or failure by the User to comply with the obligations, representations, or responsibilities detailed in these Terms.
c) Upon termination as specified in Clause 8(b):
i. Access to the Services shall be revoked or suspended (“timed-out”);
ii. Users will no longer be entitled to benefit from any features of the Services;
iii. These Terms shall stand terminated, except for those clauses that are meant to survive such termination either explicitly or by nature;
iv. All dues and pending financial obligations related to the Services must be settled by the User immediately, regardless of the reason for termination.
9. Disclaimers and Limitations of Warranties
a) You agree to use the Services at your own risk and discretion.
b) Geni Homes does not promote, certify, or recommend any Service Provider listed or functioning via the Platform. While basic eligibility checks may be conducted, Geni Homes makes no guarantees regarding the credentials, experience, insurance, licensing, or competency of any Service Provider. Any brand, trademark, supplier, or service listed does not imply endorsement or approval by Geni Homes.
c) All non-Geni Homes trademarks, brand names, and logos displayed on the Platform remain the property of their respective owners. Any cost estimate or projection offered via the Services is to be taken as indicative only and not as a binding price.
d) All transactions or dealings—online or offline—between Users and third-party providers (including payments and service agreements) are made solely between those parties. Geni Homes is not a party to those agreements and assumes no responsibility for them.
e) We strongly advise Users to perform all necessary due diligence before proceeding with any agreements or purchases from third parties via the Platform. Geni Homes disclaims responsibility for any outcomes resulting from these interactions.
f) In case of disputes between Users or with third parties, Geni Homes holds no obligation to intervene or mediate. Should any such conflict arise, you fully release Geni Homes, its affiliates, officers, employees, agents, and partners from all claims, liabilities, and damages— whether known or unknown, disclosed or undisclosed—arising from the dispute or related to the Services. You acknowledge this release as a vital condition for using our Services.
g) Geni Homes operates purely as a technological facilitator and not as a contracting or service authority.
h) To the fullest extent permitted by law, the Services are made available on an “as is” and “as available” basis. Geni Homes does not assure uninterrupted access, flawless operation, or guaranteed satisfaction of your specific requirements.
i) All implied warranties—including but not limited to fitness for a specific purpose, merchantability, accuracy, non-infringement, system compatibility, and reliability—are expressly disclaimed to the maximum extent permitted by law.
j) You assume full responsibility for any consequences arising from the use of the Platform and Services and agree that Geni Homes shall not be held accountable in any capacity.
k) To the extent legally permissible, Geni Homes and its affiliates shall bear no liability for:
i. Any interruption, inaccessibility, or technical failure related to the use of the Services;
ii. Any data loss, unauthorized access, or security breach affecting our systems or your use of Services;
iii. Any malfunction, delay, or disruption in the functionality or transmission of data via the Platform.
10. Indemnification
You agree to indemnify, defend (at our discretion), and hold harmless Geni Homes, along with its parent company, subsidiaries, affiliates, officers, employees, agents, directors, licensors, representatives, successors, and assigns from and against any claims, legal actions, proceedings, damages, liabilities, losses, costs, or expenses (including legal fees and costs of settlement) that may arise due to your access to or use of the Services, any breach of these Terms, or any misuse of your account by a third party in violation of these Terms.
11. Limitation of Liability
Notwithstanding anything stated elsewhere, Geni Homes, its affiliates, and associated entities shall not be liable to you or any third party for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to, loss of income, profits, or data, tort, or otherwise, arising from or related to these Terms or your use of the Services. To the fullest extent permitted under applicable laws, you agree to unconditionally release Geni Homes, its group companies, officers, employees, and agents from any liabilities, claims, or losses resulting from or connected to the use of the Services.
12. Consent to Use of Data
a) By using our Services, you consent to the collection and usage of your personal and technical information by Geni Homes, in line with our Privacy Policy.
b) We may use your usage data and associated information for analytical purposes, identification of usage trends, performance improvements, and to enhance the efficiency of our Services.
c) Subject to applicable laws, we may be legally required to share user information with government agencies or law enforcement authorities in the event of investigations or legal proceedings. You hereby acknowledge and agree to such disclosures when mandated.
13. Modifications
Geni Homes reserves the right, at any time and without prior notice, to modify, suspend, or permanently discontinue the Services or any portion thereof. We are not liable for any impact such changes may have on your access to or use of the Services.
14. Compliance with Laws and Regulations
a) You are solely responsible for ensuring your use of the Services complies with all applicable laws, regulations, and legal requirements at the national, state, and local levels. Any misuse or illegal use of the Services is strictly prohibited, and any penalties arising from non-compliance will be your responsibility.
b) In cases where Geni Homes determines that your usage violates any applicable laws or causes disruption to other users or third parties, we reserve the right to immediately suspend or terminate your access to the Services. We may also conduct a review of your Service settings to ensure compliance.
15. Jurisdiction, Governing Law, and Dispute Resolution
a) These Terms shall be interpreted in accordance with the laws of India. All disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bangalore.
b) Any conflict, disagreement, or dispute arising in connection with these Terms shall be resolved through binding arbitration under the provisions of the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Bangalore by a sole arbitrator appointed by Geni Homes. The proceedings shall be held in English.
c) The arbitration process shall remain confidential, and all information disclosed therein shall not be shared with any third party except legal advisors or as required by law.
d) Each party shall be responsible for its own legal costs and expenses incurred during the dispute resolution process.
16. Project Delivery
Service Location:
Our project execution services are currently available only within the Chennai region.
Eligibility Criteria:
a) Applicable only to plots ranging from 1,200 sq. ft. to 2,000 sq. ft. in size.
b) The total built-up area must be below 3,000 sq. ft.
c) The access road must be a minimum of 45 feet wide, and sufficient space must be allocated for construction materials and worker accommodation.
Payments & Project Timelines:
a) A non-refundable advance of 10% of the project value is required to initiate the project.
b) Clients are expected to adhere strictly to the agreed payment milestones to prevent project delays.
c) Approval procedures for drawings, structural designs, and work progress will be expedited. Clients may reach out to the Architect, Site Project Manager (SPM), and Project Manager (PM) as needed.
Site Conditions:
Any irregularities found during digital surveys or soil testing may result in revised project timelines.
Offer Terms:
Geni Homes reserves the absolute right to amend, suspend, or cancel any offer at its discretion, with or without prior notice.
17. Miscellaneous Provisions
a) Amendments – Geni Homes retains the right to update, revise, or supplement these Terms at any point. Any such changes or additions will be communicated to you and will take effect immediately upon receipt, unless you explicitly decline them, in which case your access to the Services will be terminated. Continued use of the Services following such modifications signifies your acceptance of the revised Terms.
b) Severability – If any section of these Terms is deemed invalid, illegal, or unenforceable by a competent legal authority, such provision shall be modified to the extent necessary to become enforceable or, if not possible, removed entirely. The remaining provisions shall continue to remain valid and enforceable to the fullest extent permitted.
c) Transfer of Rights – You are not permitted to license, assign, or otherwise transfer your rights or obligations under these Terms without our prior written approval, which may be granted or denied at our discretion. Geni Homes reserves the right to assign its obligations and rights to affiliates, subsidiaries, parent entities, or any successor in the business, without the need to notify you.
d) Notices & Communication – All formal notices, legal requests, and official correspondence relating to these Terms must be sent to crm@genihomes.in. For general inquiries or assistance, please reach out to the same email address.
e) Third-Party Enforcement – No individual or entity not party to these Terms shall have any rights to enforce or claim benefits under them.
f) Unforeseen Events – Geni Homes shall not be held responsible for any failure or delay in performance caused by events beyond reasonable control, including but not limited to natural calamities, acts of war or terrorism, civil disturbances, labour strikes, regulatory actions, or network disruptions.
g) Force Majeure – In the event of conditions that are outside of Geni Homes’ control (including any of the above), obligations under these Terms may be temporarily suspended without liability.
h) Entire Agreement – These Terms represent the comprehensive and final agreement between you and Geni Homes regarding your use of the Services. They override any previous discussions, understandings, or agreements, whether written or oral.
i) Non-Waiver – Any delay or failure by Geni Homes to enforce any part of these Terms does not constitute a waiver of such provision. A waiver shall only be valid if expressly made in writing.
j) Legal Fees – Should legal proceedings arise due to your violation of these Terms, Geni Homes shall be entitled to recover all reasonable legal costs and attorney’s fees, in addition to any other remedies provided by law or equity.
k) Use Governance – Your engagement with our website and mobile application is also governed by our Privacy Policy and other applicable policies which, together with these Terms, form the legal framework for your use of our Services.
l) User Accounts – We may require you to create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted under your account.
m) Confidentiality and Communications – You agree to keep confidential any proprietary or sensitive information related to our Services unless disclosure is legally required. Additionally, you consent to receive communications from us (via SMS, phone calls, emails, or other means) regarding promotional campaigns or service updates. Such communications shall not be considered as ‘unsolicited commercial communication’ as per Telecom Regulatory Authority of India (TRAI) guidelines. You also agree to indemnify Geni Homes and its representatives for any liability arising from false complaints made in this context.
n) Warranties Disclaimer – Where applicable, any stated 5-year warranty is extended by the respective contractor against structural defects, as governed by specific contractual agreements entered for the project. Geni Homes itself does not offer any express or implied warranty for construction quality, structural integrity, or any defects that may occur.
